I NEED LEGAL HELP!!!! There was a car crash at my house last year....?

A man came off the road at a high rate of speed at 3 AM and T-boned my truck, pushing it into my boyfriend's car and through the chain link fence, where the whole mess blew up, a few feet from the house. the front of the house was severely damaged, the windows were blown out and the man died in my front yard. We were woken up by someone who saw the crash, jumped the fence, and was banging on the door to wake us up. When I finally got out it was pitch black and I was running across the back deck to get a hose to wet down the house and the 500 gallon propane tank next to the fire. As I was running I stepped off the deck and fell 5-6 ft. As I lay there my boyfriend was screaming to get up and I couldn't initially. I told him to just take the hose and get to the fire before we lose everything. I eventually got up, but was numb for several days. Then the pain started to creep in and I went to the Dr. to get it checked. CTs and x-rays were done and there were no breaks noted. I have been in pain ever since. Not only all that, but all my i.d.s were in the truck in my briefcase, so I was left with no id, so I could not get any rental car. I was without transportation for 2 months. When I finally did get a rental the insurance company would not pay for it; I put it on my credit card ($3,000), thinking the whole mess would be taken care of eventually with insurance. I thought it would be easy to deal with, as I had lots of house and car insurance, and I thought the man did too, but that is not the case. He had limited liability insurance, but lots of bodily insurance. While I am usually a strong person, having a guy die in the front yard (and the family coming soon after and wanting to erect a shrine to him in my front yard), as well as the financial and emotional tolls (I had just finiahed getting the house remodeled and gone through a bad divorce, just getting back on my feet), I started to become "unglued"; people at work were very concerned and the doctor was ready to take drastic measures. Despite all I have been through in my life, I have never been on any sort of meds. I was now being pushed to take something, which I had been stubbornly refusing, thinking I would be OK. I eventually did take it as I started to get scared from the anxiety and panic that were constant as well as the inability to sleep. Bottom line- his insurance company hasn't paid anything, not to my insurance companies or me. They are now saying the case is closed and I never suffered any injury or problems from this matter. I have gone to several lawers, both contingency and otherwise who say they can't take the case because there isn't enough money involved. CAN SOMEONE HELP ME PLEASE?????

  1. Your claim would be against the estate of the man or whoever caused all this damage. If there is no money in the estate, then there is no money for you.
  2. You are right, you need a lawyer. Get some recommendations from friends, and then call and set up a consultation. This will give you a chance to talk to the attorney about what happened, and about what he thinks you should do. You might have to pay him for an hour of his time (although a lot of lawyers do NOT charge for a consultation - ask when setting up the appointment), but that is worth it to have good, solid advice and a realistic idea of what can be done, isn't it? You can also call the state bar association in your state and ask for their lawyer referral service. They can give you the name of competent attorneys in your area.
