Life insurance trying to skip out. What to do?

Life insurance trying to skip out. What to do? So my Dad was diagnosed with cancer three years. They went to any insurance company about two years ago and he told them that he had cancer. They said no problem we insure cancer patients and gave him whole life insurance. Valid the moment he signed. So now he passed away in December and the Insurance company is saying that he lied about having cancer and they won't pay for his funeral. they just refunded my step mom the money he paid toward it. Is there anything I can do to get them to pay up short of knocking their teeth down their throats?

  1. Demand a copy of the insurance application. He should have written somewhere there that he had cancer. If the agent just said, "Oh, we insure cancer patients", then you may have a problem, since agents can't change anything. However, if your dad died AFTER two years from the date he signed the policy application, then the incontestibilty period has expired and they are likely liable to pay anyway. If before the two years and they can prove your dad didn't tell them. then they are saing they just have to pay the premium back. Call your state insurance agency as well and file a complaint if necessary against the insurance company. If it's the agent's fault (and maybe even a lie or outright misrepresentation by him/her) you may be able to put in a claim against his E & O insurance (Errors and omissions) insurance. I'm not sure about that, but your state insurance commission can tell you if that's an option
