My mother and step-father passed away 2months apart in the state of N.J.?

The house or deed is in my mothers name only.... i want to know does it goes under my step-father estate automatically or does it go under my mothers estate because he never had the deed transfer into his name before he died. He made me beneficary under his life insurance with AARP but because he didn't answer the questions correctly in regards to his health i was refunded the premiums. His brothers and sisters want my mothers house because they are under the impression that it was his because my mother hasn't work for years but don't know that the house is in my mothers name only. I got a attorney and under his guidence i was made administrator because they both didn't have a will. My parents were married for 35yrs and i am 36 now and i don't want everything to go to my uncles and aunt when my parents have raised me all of my life and when i got older i have stayed in their lives to look after them due to health issues. I'm so stressed b/c iam alone in this no brothers or sisters.

  1. It is a complicated subject and I wish you the best personally I would say you should keep it all cuzz you took the time and effort to care for them when they needed it and the rest obviously don't care about your grief ....GOOD LUCK
  2. I say if your the administrator you have the power to make the dicision, only that you must give your brothers,and sisters $10.00 each that the laws. Isay that it under your mom name that you are power of attorney to do whatever you please after the judge order you full responsibilty of ownership., but be careful your attorney can ask for a large fees then your force to give up the house so play with caution.
