Divorce in Minnesota??? No rights?

Due to state laws a business woman in a physically and verbally abusive marriage in minnesota, has to pay her cheating, abusive husband half of her retirement, give him half her business, half of her life insurance that her parents are the owners of. Also, he recently sent her to the hospital, so he could lose his job as a TEACHER, so she would have to pay even more!! Is this even possible, or is MN that messed up. We've told her to get a different attorney, but theattorney's say it doesn't matter. REALLY? This whole thing doesn't make sense. He cheats and beats and gets paid? Any tips or help or confirmation that the way it is etc.

  1. Tell her to move to a different state or country. where she'd be safe and maybe the law would be more on her side. He should be going to jail. see if she can clean out her account and hide her money with a trusted friend or family. But she really needs to get herself out of his reach.
  2. If you are married for at least 10 yrs, he is entitled to 1/2 of your retirement. The rest, I doubt it. But you need a lawyer on this since its a business involved.
  3. Unfortunately, that's the way it is pretty much everywhere. Any money they acquired within the marriage gets divided (usually 50/50). It sucks, but the law is in place to protect both men and women equally in any and all circumstances, and unfortunately your friend is one of the unlucky ones who gets screwed over.
  4. Minnesota is a no-fault state just like Colorado is. They don't care what the reasons for divorce are ( cheating, abuse etc..) and yes it is messed up. Depending on the length of the marriage, one of them can get spousal support. Here in Colorado anything under 6 yrs. is considered a short term marriage and if you are lucky you may only get 4-5 months of spousal support, they can also go after the retirement etc... for the time you were married.
  5. Don't do anything until you do all this: 'Sell' or 'sign-over' your share of your business (on paper anyway, no money needs to exchange hands) to someone you really trust. Put any other money you may have in an account in another state and use this same friend' name for the money. Cancel your life insurance or cash it out and store the money in the 'friend's account'. Move to California, or another place where he cannot find you. You may have to use a dummy address - have a divorce address and a real address. Then file for divorce. You need to get ice in your veins in order to make this work. Also do not be alone with him ever again. Basically cash everything you can in. Stop making house payments and pocket the cash. You can in fact cash in 401Ks, IRAs. Yes, you will have to pay a substantial fee for early withdrawal. Who cares! 70% of a retirement fund is better than 50%!! Just do it all BEFORE you take out divorce papers.
  6. No fault divorce laws. Nobody complains when a woman makes out like a bandit after depriving hubby of sex, but if a man is awfull and gets his payout in divorce, its not right o.O ?
