If I die in a car accident could a Life Insurance company deny my claim?
I smoke a cigar about 4-5 times a year. If I fill out my life policy as a non-smoker and 7 years into my policy I die in a car accident. Would the life insurance company do an investigation to see if I was a smoker? Could they deny the claim if they found nicotine in my system? How could they prove that I lied on my policy? Thanks,

- They will drop you for anything they can. Insurance is the biggest scam on the planet, basic liability is all you need.
- Insurance companies have massive resources dedicated to looking for any indication of fraud. In fact, they have gotten together and set up a huge computer network with EACH OTHER, by sharing potential information that may help discover any deceptions. For example, if you have ever had an insurance claim for anything, then you are in the data base. If your name starts popping up over and over. By itself, no big deal, but the computer looks for patterns such .there are 99 such clams in say six months , clearly that is far more than normal, and the computer would spit that back our because it shows a recognized pattern of behaviour with all the repititious claims.
- Yes they can deny the claim. Misrepresentation on the application is grounds to deny the claim and void the policy regardless of how much time goes by. The insurance company would refund premiums paid though.
- I think that 4-5 cigars a year that for medical/health purposes that does NOT make you a smoker. Especially if you die in a car accident (that is NOT suicide). Maybe you should be up front and send a letter to your ins and say - i smoke a cigar every two months. Does that disqualify me from the non-smokers rate? If they say "yes" they will raise your rate. If they say "NO" you are ok. Better to find out now than years in the future after you have already paid years of premiums.
- Archie There is a clause that all claims filed within the first 2 years can and will be denied, being that it is 7 years into the policy you will be covered. After 2 years even suicides will be covered. However, they still could build a case and not pay if they have a reason to believe it's fraud.
